The State of Connecticut requires a tangible office space to operate a Home Health Care Agency that is ADA compliant (P.O. Boxes are not acceptable addresses). There is usually a distance requirement for all Home Health Agencies which means you can only serve patients within the designated service area without having to open another agency.

Home Health Care Agencies will have to undergo a 8 – 12 month process after licensure to receive reimbursement or payments of any kind from Medicare (if it is available to be applied for as this varies state to state). Medicaid is available in the State of Connecticut for Home Health Agencies to apply after a year of service. Private insurances often have stipulations that a home care or home health care agency must be Medicare certified to participate in their programs, in some cases, Private Duty Accreditation can be achieved in lieu of Medicare Accreditation. Every Agency that starts out is Private Pay and develops alternate payment sources after they are properly credentialed.

Home Health Care Agencies have strict requirements set by the State of Connecticut and  Center for Medicare / Medicaid Services for the state of Connecticut for the staff which are not negotiable due to the factors of skill and education required to deliver quality care. Owners and key staff must be able to pass a background checking process in the State of Connecticut . These requirements are described in the Conditions of Participation, State Operations Manual Appendix B, and the State of Connecticut Regulations for Home Health Care Agencies. These are  regulations to let perspective owners know how to properly run this type of business and get licensed to protect potential patients. Researching the proper regulations is a must in this industry as the state has it’s own set of regulations and also follows the federal guidelines known as conditions of participation. 

The State of Connecticut requires: 

Clinical Laboratory Director (CLIA) & Professional Advisory MD

Clinical laboratory director and Professional who must hold a doctorate in a related health field with an active license.

Admin Requirements: 19-13-D67. Personnel

 (a)      The administrator of an agency shall be a person with one of the following:

(1)       A master’s degree in nursing with an active license to practice nursing in this state and at least one (1) year of supervisory or administrative experience in a health care facility program which included care of the sick; or

(2)       A master’s degree in public health or administration with a concentration of study in health services administration, and at least one (1) year of supervisory or administrative experience in a health care facility/program which included care of the sick; or

(3)       A baccalaureate degree in nursing with an active license to practice nursing in this state and at least two (2) years supervisory or administrative experience in a health care facility/program which included care of the sick; or

(4)       A baccalaureate degree in administration with a concentration of study in health services administration and at least two (2) years’ supervisory or administrative experience in a health care facility/program which included care of the sick; or

(5)       A physician licensed to practice medicine and surgery in the State of Connecticut who has had at least one (1) year supervisory or administrative experience in a health care facility/program which included care of the sick; or

(6)       Employment as the administrator of a home health care agency in this state as of January 1, 1981, who has been so employed continuously for the five (5) years immediately preceding January 1, 1981; or

(7)       Continuous employment as an administrator of a home health care agency as of January 1, 1979; except that on and after January 1, 1986, no person shall be employed as an administrator of a home health care agency pursuant to this subdivision unless such person additionally meets one of the requirements of subparagraphs (1) through (5) inclusive above.

Supervisor of Clinical Services:

 An agency supervisor of clinical services shall be a registered nurse with an active license to practice nursing in this state, and shall have one of the following:

(1)       A master’s degree from a program approved by the National League for Nursing or the American Public Health Association with a minimum of one year (1) full-time clinical experience in a home health agency or related community health program which included care of the sick at home; or

(2)       A baccalaureate degree in nursing and a minimum of three (3) years of full-time clinical experience in nursing, at least (1) one of which was in a home health agency or community health program which included care of the sick at home; or

(3)       A registered nurse who has been continuously employed in the position of supervisor of clinical services in a home health agency in this state since January 1, 1979; or

(4)       A diploma in nursing or an associate’s degree in nursing and

(A)      A minimum of three years of full-time or full-time equivalent clinical experience in nursing within the past five years, at least one year of which was in a home health care agency or community health program which included care of the sick at home; and

(B)       Evidence of certification by the American Nurses’ Association as a community health nurse or completion of at least six credits received within two years in community health nursing theory or six credits in health care management from an accredited college or university program or school of nursing.

(c)       An agency supervisor of physical therapy services shall be a registered physical therapist licensed to practice physical therapy in this state who has a minimum of three (3) years’ clinical experience in physical therapy.

(d)       An agency supervisor of occupational therapy services shall be an occupational therapist licensed to practice occupational therapy in this state who has a minimum of three (3) years’ clinical experience in occupational therapy.

(e)       An agency supervisor of speech pathology services shall be a speech pathologist licensed to practice speech pathology in this state who has a minimum of three (3) years’ clinical experience in speech pathology.

(f)        An agency supervisor of social work services shall be a graduate of a master’s degree program in social work accredited by the Council on Social Work Education who has a minimum of three (3) years’ clinical experience in social work

(e) Supervisor of Clinical Services; 19-13-D68(e)(4)

(1) An agency shall employ one full-time supervisor of clinical services for each fifteen (15), or less, full-time or full-time equivalent professional direct service staff.

(2) The supervisor of clinical services shall have primary authority and responsibility for maintaining the quality of clinical services.

(3) The supervisor’s responsibilities include, but are not limited to:

(A) Coordination and management of all services rendered to patients and families by direct service staff under his/her supervision;

(B) Supervision of assigned nursing personnel in the delivery of nursing services to patients and families;

(C) Direct evaluation of the clinical competence of assigned nursing personnel and participation with appropriate supervisory staff in the evaluation of other direct service staff;

(D) Participation in or development of all agency objectives, standards of care, policies and procedures affecting clinical services;

(E) Participation in direct services staff recruitment, selection, orientation and inservice education;

(F) Participation in program planning, budgeting and evaluation activities related to the clinical services of the agency.

(4) The supervisor of clinical services may also serve as the administrator in agencies with six (6) or less full-time or full-time equivalent professional direct service staff.

(5) Any absence of the supervisor of clinical services for longer than one month must be reported to the commissioner. A registered nurse who has at least two (2) years’ experience in a home health care agency, shall be designated, in writing, to act during any absence of the supervisor of clinical services whenever patient care personnel are serving patients

HHA for Service

Need to show proof of employment for a licensed Homemaker Home Health Aide with a competency evaluation.

CMS requires personnel to be supervised. The following supervisory roles must meet the following educational requirements (§ 484.115) Condition of participation: Personnel qualifications.

Administrator and Alternate Administrator

(1) For individuals that began employment with the HHA prior to July 13, 2017, a person who:

(i) Is a licensed physician;
(ii) Is a registered nurse; or
(iii) Has training and experience in health service administration and at least 1 year of supervisory  administrative experience in home health care or a related health care program.

(2) For individuals that begin employment with an HHA on or after July 13, 2017, a person who:

(i) Is a licensed physician, a registered nurse, or holds an undergraduate
degree; and

(ii) Has experience in health service administration, with at least 1 year of supervisory or administrative experience in home health care or a related health care program.

Director of Nursing and Alternate Director of Nursing also known as a Clinical Manager

(1) A person who is a licensed physician, physical therapist, speech-language pathologist, occupational therapist, audiologist, social worker, or registered nurse.

Secretary of State Formation, Employer Identification Number, State Tax ID, and a National Provider Identification number will be needed to get your home care business started. You will need a tangible address to start the agency (P.O. Boxes are not acceptable). Per State and CMS guidelines the State of Connecticut requires the following for home health care agencies in Connecticut:

General/Professional liability, Workman’s Compensation.

Application – The State of Connecticut requires a notarized application to the Department of Health accompanied by a fee of $300. The key staff and owners must show proof of background checks and educational requirements in the application. The Home Health application needs to be accompanied with Home Health Care Policies and other key paperwork proving regulation compliance. Processing time for applications is roughly 9-12 Months depending on their work loads after the application is submitted.

License – The initial Home Health License is granted for a period of 12 month and then a survey will be required after renewal application is submitted. Medicare is a federal insurance that is for seniors over the age of 65 and individuals who are disabled. Medicaid is the state assisted insurance for all ages and disabilities to reduce costs to all individuals who otherwise could not afford health insurance. Center for Medicare & Medicaid Services (CMS) regulate both and there are specific requirements and regulations that must be met and followed. These government insurance enrollments can be very difficult to navigate and can take 12 months before a Home Health Agency receives a billing number for reimbursement on patient claims, if the insurance program is available for enrollment. Private Insurances such as Blue Cross Blue Shield, AETNA, Tufts, United Healthcare, and other PPO / HMO plans can also be used for reimbursement if the Home Health Agency has enrolled with each specified insurance company. All insurances will have separate requirements needed for enrollment.  

Home Health Agency requirements for enrollment in insurance programs may also include a certification that is issued from a nationally recognized accreditation organization (AO) to participate in their program. Certification for the home health agency not only validated that the agency knows what they are doing but can assure the family and patient a sense of comfort they are in capable hands. Assuring quality care with proof of certification makes insurance companies feel the same and in most cases is part of the requirement for the Home Health Agency to do business with them.

Accreditation requires that a great infrastructure be present with the correct key staff, supporting policies, business paperwork, and an ADA Compliant Office Space.  Creating this optimal environment can be very difficult without proper direction and insight. Accreditation Organizations such as Community Health Accreditation Partner (CHAP) or Accreditation Commission for Health Care (ACHC) have their own fees for their services and processes.
